Trump Advisors Plan to Privatize Native Lands to Tap Into Oil Rich Reservations

The Dakota Access Pipeline (DAPL) is only one battle in a larger war. Following news of the Army Corps’ decision to halt the pipeline’s construction, Reuters reported that President-elect Donald Trump’s advisors are seeking to privatize Native American reservations, which sit on an estimated 20 percent of the nation’s oil and gas, along with large amounts of coal reserves. These resources are worth nearly $1.5 trillion.

“We should take tribal land away from public treatment. As long as we can do it without unintended consequences, I think we will have broad support around Indian country,” said Rep. Markwayne Mullin (R-OK), a Cherokee tribe member and chair of Trump’s 27-member Native American Affairs Coalition.
The formation of the coalition was announced in October with the aim of electing Trump for president.
“As a local elected official, I am outraged that Indian Country is prevented from harnessing our own energy resources by ever-increasing regulations,” state Rep. Sharon Clahchischilliage (R-NM 4th District), a Navajo tribe member and coalition co-chair, said in October. “The Trump Administration will ease restrictions on American energy reserves worth trillions of dollars. Together we will block the bureaucrats holding Native American businesses back and bring new jobs into our communities.”
As it happens, three of the four chair-level coalition members have ties to Big Energy. According to campaign finance disclosures cited by Reuters, Mullin has received about eight percent of his campaign funds from energy companies while Clahchischilliage has received about 15 percent of her campaign funds from energy companies.
Fellow co-chair and Cherokee nation ex-chief Ross Swimmer said it is possible to privatize reservations while limiting land sales to non-Indian buyers.
“It has to be done with an eye toward protecting sovereignty,” said Swimmer, who is a partner at an Native American-focused investment fund that has invested in Energy Transfer Partners, the owner of the heavily contested DAPL.
However, prominent Native American leaders have spoken against privatization.
“Our spiritual leaders are opposed to the privatization of our lands, which means the commoditization of the nature, water, air we hold sacred,” said Tom Goldtooth, who runs the Indigenous Environmental Network and is a member of both the Navajo and the Dakota tribes.
“Privatization has been the goal since colonization—to strip Native Nations of their sovereignty,” Goldtooth added.
Thousands of Dakota Access Pipeline protestors are celebrating after the Army Corps’ rejection of the DAPL project but many water protectors also recognize the fight is not yet over. As Goldtooth said, this is “check, not checkmate.”
Despite the Army Corps’ decision, Energy Transfer Partners said that it is still committed to seeing this “vital” pipeline “brought to completion.”
Trump has holdings in Energy Transfer Partners and officially voiced support for the pipeline, even though his team said his support “had nothing to do with his personal investments and everything to do with promoting policies that benefit all Americans.” The incoming president has also picked climate change deniers and pro-fossil fuel bigwigs for cabinet positions.
Not only that, many pro-drilling politicians currently sit in a GOP-controlled House of Representatives and Senate. Following the Army Corps’ Sunday announcement, House Speaker Paul Ryan (R-Wis.) tweeted: “This is big-government decision-making at its worst. I look forward to putting this anti-energy presidency behind us.”

A six-inch crude oil pipeline operated by Belle Fourche Pipeline Company in western North Dakota was shut down following discovery of a leak on Monday. The amount of the spill was not immediately known, but oil has leaked into the Ash Coulee Creek in Billings County.
The site of the spill is about 200 miles from the camp where members of the Standing Rock Sioux Tribe and their supporters have been protesting the construction of the Dakota Access Pipeline.
“It is a significant spill,” Bill Suess, spill investigation program manager for the North Dakota Department of health, said.
“A series of booms have been placed across the creek to prevent downstream migration and a siphon dam has been constructed four miles downstream of the release point.”
The Belle Fourche Pipeline Co. is part of the family-owned True companies, which also operates Bridger Pipeline LLC. Both pipelines are operated from the same control room in Casper, Wyoming. From 2006 to 2014, Belle Fourche reported 21 incidents, leaking a total of 272,832 gallons of oil. Bridger Pipeline recorded nine pipeline incidents in the same period, spilling nearly 11,000 gallons of crude.
“In general, Bridger has a poor compliance history,” wrote a federal regulator charged with overseeing pipeline safety in a 2012 order regarding a 2006 oil spill.
A Belle Fourche pipeline that spilled 12,200 gallons in May, 2014 occurred on Bureau of Land Management (BLM) land near Buffalo, Wyoming. It was later discovered that Belle Fourche did not have a permit to operate the land. Its sister company, Bridger, was fined $27,029 for trespassing by the BLM.
Bridger was also responsbile for dumping up to 50,000 gallons of crude into the scenic Yellowstone River in 2015.
While operators claim that oil pipelines are safer than trains or trucks, an aging infrastructure and inadequate oversight leads to numerous leaks, most of which never make headlines. A Nov. 30 analysis by Citylab revealed that more than 9,000 significant accidents over the past 20 years have resulted in 548 deaths, 2,576 injuries and more than $8.5 billion in financial damages. An Oct. 25 analysis by EcoWatch found 220 significant pipeline spills to date in 2016 and showed that the number of significant pipeline incidents has grown 26.8 percent from 2006 to 2015.
The Belle Fourche and Bridger pipelines transport crude oil in the Williston Basin of western North Dakota and eastern Montana and the Powder River Basin of Wyoming.

There are incident in Kansas City pipeline explosion. Was there a leak? You can bet there was. They are fracking all over this biosphere making swiss cheese out of our rocks. Hundreds of water protectors were injured at the Standing Rock encampments when law enforcement blasted them with water cannons in freezing temperatures Sunday evening. The attacks came as water protectors used a semi-truck to remove burnt military vehicles that police had chained to concrete barriers weeks ago, blocking traffic on Highway 1806. Water protectors’ efforts to clear the road and improve access to the camp for emergency services were met with tear gas, an LRAD (Long Range Acoustic Device), stinger grenades, rubber bullets, and indiscriminate use of a water cannon with an air temperature of 26 degrees Fahrenheit. Some flares shot by law enforcement started grass fires which were ignored by the water cannons and had to be extinguished by water protectors. Law enforcement also shot down three media drones and targeted journalists with less lethal rounds.
National Lawyers Guild legal observers on the frontlines have confirmed that multiple people were unconscious and bleeding after being shot in the head with rubber bullets. One elder went into cardiac arrest at the frontlines but medics administered CPR and were able to resuscitate him. The camp’s medical staff and facilities are overwhelmed and the local community of Cannonball has opened their school gymnasium for emergency relief. The Standing Rock Sioux Tribe’s Emergency Medical Service department arrived on scene to administer medical services. The Cheyenne River Sioux Tribe also sent Emergency Medical Service vehicles to the Oceti Sakowin Camp to assist. Hundreds are receiving treatment for contamination by CS gas, hypothermia, and blunt traumas as a result of rubber bullets and other less lethal ammunition. The military vehicles blocking the bridge were burned in a blockade fire on October 27, after law enforcement raided and cleared the “1851 Treaty Camp,” an occupation of the pipeline corridor and reclamation of unceded territory. Despite the obvious public safety risk, and despite promises from Morton County that they would clear the road, law enforcement has insisted on keeping the vehicles on the bridge for weeks. This obstruction of Highway 1806 threatens the lives of the water protectors and residents of the Standing Rock Sioux Reservation, as emergency services have been needed but unable to reach camp quickly. The blockage also unjustly restricts the free movement of local residents and hurts the Tribe economically by cutting off travel to and from the Prairie Knights Casino. Images of the burned vehicles have fed negative, distorted, and sensationalist media portrayals of the encampment.
Tara Houska, National Campaigns Director for Honor the Earth, says, “For weeks, the main highway to the Standing Rock Sioux Reservation has been cut off, with no movement by the state to address a public safety risk. Attempting to clear the road was met with police spraying people with water cannons in 26 degree weather — that’s deadly force, it’s freezing outside. They want to kill people for clearing a road? When will our cries be heard? Stop the Dakota Access pipeline. Respect the rights of indigenous people, of all peoples.”
LaDonna Allard, Director of the Sacred Stone Camp, says, “All I can say is why? We are asking for clean water, we are asking for the right to live, we are asking for our children to live. Instead they attack us, because they protect oil. Morton county and DAPL security are inhuman- what is wrong with their hearts?”
Dallas Goldtooth, Indigenous Environmental Network, says, “It is below freezing right now and the Morton County Sheriff’s Department is using a water cannon on our people, that is an excessive and potentially deadly use of force. Tribal EMS are stepping up and providing services that should be the responsibility of Morton County, this is ridiculous. Because of the police enforced road block, ambulances now have an extra 30 minutes to get to the hospital. Those are life and death numbers right there, and Morton County and the State of North Dakota will be responsible for the tally.”
The Standing Rock Medic and Healer Council released this statement: “The physicians and tribal healers with the Standing Rock Medic and Healer Council call for the immediate cessation of use of water cannons on people who are outdoors in 28F ambient weather with no means of active rewarming in these conditions. As medical professionals, we are concerned for the real risk of loss of life due to severe hypothermia under these conditions.”Sunday’s skirmishes began around 6 p.m. after protesters removed a burned-out truck on what’s known as the Backwater Bridge, not far from the encampment where they’d been for weeks as they demonstrated against the pipeline.
